A necessary category should be reviewed against the function the visitor requested and the actual uses of the information. A tool can supply a needed feature and also collect information for an optional purpose.
Start with the purpose. Business importance, a vendor name, or placement in an essential category does not complete the assessment.
Compare purposes described as necessary
Switch between a basket, advertising measurement, and a tool combining security with marketing. Assess the purpose behind the label.
- Declared purpose
- Keep items in the requested shopping basket
- Enabled use
- Basket state only in this fixture
- Review question
- Is the storage needed for the requested service?
Review necessity against the visitor's requested function and the actual uses of the information.
Next check: Confirm that the integration doesn't also reuse the state for an optional purpose.
Invented observations for teaching. Manual-debugger details illustrate evidence beyond CookieTrail’s current standard capture. Colors describe this example’s evidence or stated policy, not legal compliance.
Identify the requested function
Write a short explanation of what would stop working without the storage or access. Record what the visitor asked the site to do. Keeping items in a basket and supporting authentication are different purposes from measuring advertising revenue.
ICO guidance assesses strict necessity from the user's perspective and says funding a service through advertising does not make advertising cookies strictly necessary. It also warns that a necessary purpose does not cover additional uses.
- ICO strictly necessary exception Requested functions and the effect of secondary purposes.
Germany's section 25 TDDDG has limited exceptions for transmission and storage or access strictly necessary to provide an expressly requested digital service. Review the applicable conditions rather than importing an exemption from another jurisdiction.
- Section 25 TDDDG The German statutory consent rule and exceptions.
Inspect integrations with more than one purpose
- Security or fraud prevention with optional profiling enabled.
- A chat feature that also records browsing behavior before the visitor opens it.
- An embedded service that supplies requested content and additional measurement.
- A single script bundle containing necessary and optional tools.
These are review scenarios, not automatic findings against every such integration. Examine settings, activation timing, data reuse, and whether optional features can be disabled or controlled separately.
Don't assume that approving the necessary function approves the entire bundle. Conversely, a connection to a third-party service alone doesn't identify an optional purpose. Inspect what the integration does.
Compare the category and behavior across regions
Capture the declaration and assigned category at each relevant visitor location. Look for differences in the explanation and the controls. Start fresh before choice and after rejection, then inspect the tool's behavior over comparable windows.
If a tool sits outside consent controls, ask the policy owner to document the purpose and rationale. Ask the implementation owner to confirm that the deployed features stay within it. Keep the decision and the verification together.
Review unclassified tools separately: an unknown purpose is not evidence of necessity.
Use category evidence carefully
A future study could compare how often a particular integration is placed in necessary, functional, analytics, or marketing categories. That measures categorization. Calling the category improper additionally requires purpose and applicability evidence.
Count independent eligible sites where both the tool and its declared category were established. Report ambiguous descriptions and unavailable declarations separately. Don't convert a scanner's own category assignment into a claim about the site's policy.
CookieTrail's standard captures provide regional cookie and recognized-request baselines. Reviewing declarations, enabled features, and purpose separation requires extra evidence. After a configuration change, rerun the affected URL and visitor region and repeat the additional feature test.
